1. Activity and participant

Family Tree Adventures LLC provides guided recreational tree-climbing instruction using climbing equipment and rope systems. Activities may include walking on uneven ground, equipment fitting, ground practice, ascending, moving within a tree and descending. This is recreational instruction, not occupational certification.

2. Risks and voluntary participation

Tree climbing has inherent risks that instruction, equipment and precautions cannot eliminate. Examples include falls; swinging or striking a tree, equipment or another person; rope friction and entanglement; equipment misuse or failure; falling branches or objects; unstable ground; changes in tree condition; insects or wildlife; exertion, fatigue and suspension in a harness; changing weather; and delayed rescue or medical assistance. Injury may be serious or permanent and may include paralysis or death. Property may also be damaged.

I understand these examples are not a complete list. Before participating, I will have an opportunity to ask questions and consider whether to take part. I may decline an activity, request a break or stop participating. I will tell a climbing instructor when I need help; stopping while aloft may require an assisted descent.

3. Participant responsibilities

I will provide accurate eligibility and experience information, follow the climbing instructors' directions, attend the equipment briefing and use equipment only as instructed. I will not disconnect, adjust or use a climbing system without the instructor's direction. I will report discomfort, damaged equipment, uncertainty or changing conditions promptly and will not participate while impaired by alcohol, drugs or any condition that prevents me from following instructions.

I will discuss relevant limitations or accommodation needs privately with the business before the session. I will seek advice from my own health professional when uncertain about my ability to participate. Instructors may pause or stop an activity because of conditions or participant readiness. This agreement does not promise that a particular height, route or skill will be completed.

4. Adult release — proposed language for attorney review

PROPOSED ADULT-ONLY RELEASE: If included in the final attorney-approved agreement, I, as an adult participant acting only for myself, would voluntarily accept the inherent risks of the described activities and release Family Tree Adventures LLC and its owners, employees and climbing instructors from claims for my injury or property damage arising from those activities, including claims based on their ordinary negligence, only to the extent Washington law permits. This proposed release would not cover gross negligence, reckless or intentional misconduct, or any liability that cannot lawfully be released.

This paragraph is a drafting example, not a presently effective release. No person is asked to waive rights by viewing or acknowledging this sample. It does not release another adult's claims or a child's claims. Counsel must determine the final scope, prominence, parties and enforceability before use.

5. Minors and guardian permission

For a participant under 18, a parent or legal guardian must separately confirm their identity, relationship and authority to consent to participation, review the activity information and provide current contact details. Buying a class for a child does not by itself establish guardianship. The child should receive an age-appropriate explanation of the activity and may ask to stop.

The proposed guardian agreement would grant permission for the child's participation subject to the approved program requirements. It would not purport to waive the child's own injury claims or require a guardian to indemnify the business for those claims. Adult participants each review and sign their own final agreement; one purchaser cannot sign for all adults in a group.

6. Emergency response

If an emergency occurs, I ask the climbing instructors to contact emergency services, communicate relevant information to responders and contact the emergency contact or guardian listed for the participant. Appropriate first aid may be offered within the responder's training. Medical professionals will determine treatment and obtain consent as required by applicable law. This sample does not appoint an instructor as a health-care decision maker or replace a medical consent process.

7. Booking, payment and weather terms

The approved booking quote and separate booking policy govern pricing, deposits, cancellation and rescheduling. Current proposed terms request at least 24 hours' cancellation notice; deposits remain refundable. A 50% deposit is followed by the remaining 50% upon completion of the session. Staff review the forecast manually: the chance of rain must be below 10% throughout the session, with no rain expected during the session. Meeting that forecast threshold does not guarantee suitable conditions; instructors may stop or reschedule for weather or other hazards.

Acknowledging this sample does not confirm a date, approve a customer-proposed tree, collect payment or satisfy a final waiver requirement. A booking and its location require separate approval.

8. Separate permissions

Photo and video permission is optional and separate from participation. A final optional release should identify the permitted uses, who may appear and how to decline. No marketing-photo consent is granted by this sample, and declining it does not affect eligibility to climb.

Customer-proposed locations need separate property-owner authorization and instructor review. A participant's waiver does not grant access to someone else's property or establish that a tree is suitable for climbing.

9. Final document and signature process

Before real use, the business and its Washington attorney must approve the final document and signing process. Each applicable participant or authorized guardian must receive the complete version, have an opportunity to ask questions, expressly agree to any electronic signing process and receive a copy of the completed record. The retained record should identify the participant, signer, guardian capacity if applicable, exact document version and text, date and time, and separate consent choices.
